Hyperliquid Protocol Agreement
By using Atract to trade on Hyperliquid, you also agree to Hyperliquid's terms and policies:
1Acceptance of Terms
By accessing or using Atract (the "Interface" or "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
2Service Description
Atract is a non-custodial user interface that enables you to interact with the Hyperliquid blockchain for perpetual futures trading. The Platform provides:
- A trading terminal interface
- Vault management tools for funding arrangements
- Performance analytics and leaderboard
- Automated risk monitoring services
3Eligibility and Prohibited Jurisdictions
3.1 Age and Capacity
You must be at least 18 years old and have legal capacity to enter into contracts.
3.2 Compliance
You must comply with all applicable laws in your jurisdiction.
3.3 Prohibited Jurisdictions
Access to the Platform is prohibited from:
- United States of America
- Canada
- OFAC-sanctioned countries (Cuba, Iran, North Korea, Syria, Crimea region)
- Any jurisdiction where cryptocurrency derivatives trading is prohibited
Attempting to circumvent geographic restrictions via VPN or other means is a violation of these Terms and may result in immediate termination of access.
4Interaction with the Hyperliquid Protocol
4.1 Nature of the Protocol
You acknowledge that the Atract Interface is merely a visualization layer and transaction composition tool that enables you to interact with the Hyperliquid Blockchain ("The Protocol"). The Protocol is a decentralized Layer 1 blockchain network operated by a distributed set of validators over which Atract ("The Interface Provider") has no control.
4.2 Acceptance of Protocol Risks
By using the Interface to transmit transactions to the Protocol, you explicitly accept the risks associated with the Hyperliquid ecosystem, including but not limited to:
- (a) Consensus Failure: The risk that the HyperBFT consensus mechanism may experience liveness failures, safety violations, or chain reorganizations.
- (b) Bridge Dependency: The risk that assets bridged from Arbitrum or other networks via the Protocol's bridge smart contracts may be lost, delayed, or stolen due to smart contract exploits.
- (c) Oracle Risk: The risk that the Protocol's internal price oracles may malfunction or deviate from external market prices, resulting in erroneous liquidations.
- (d) Smart Contract Risk: The risk that smart contracts on HyperEVM or HyperCore may contain bugs, vulnerabilities, or be exploited.
4.3 Protocol Terms Pass-Through
Your use of the Protocol may be subject to the governance rules, terms of service, or community guidelines established by the Hyper Foundation or the Protocol's decentralized governance (HYPE token holders). You agree that it is your sole responsibility to review and comply with these underlying Protocol rules. The Interface Provider shall not be liable for any enforcement action (e.g., wallet blacklisting, transaction censorship) taken by the Protocol's validators or governance.
5Decentralized Funding and Profit Sharing
5.1 No Investment Advice
The Interface provides access to "Decentralized Funding" tools that allow users to deploy capital to other users' strategies. You acknowledge that the Interface Provider is not an Investment Adviser, Commodity Pool Operator, or Broker-Dealer. The availability of a "Track Record" or performance metric on the Interface does not constitute an endorsement, recommendation, or verification of that trader's skill or reliability.
5.2 Peer-to-Peer Relationship
Any "Profit Sharing" or "Funding" arrangement entered into via the Interface is a direct peer-to-peer contract between the Investor and the Trader. The Interface Provider is not a party to this arrangement, does not custody the funds, and cannot enforce the payment of profits or the return of capital.
5.3 Accuracy of Track Records
All performance data ("Track Records") displayed on the Interface is derived programmatically from on-chain data. The Interface Provider does not warrant the accuracy, completeness, or continuity of this data. You acknowledge that on-chain data can be manipulated (e.g., via "wash trading") and agree to conduct your own due diligence before deploying capital.
5.4 No Fiduciary Duty
The Interface Provider owes no fiduciary duty to any user. Any "Profit Sharing" or "Funding" arrangement entered into via the Interface is a private, peer-to-peer agreement between the Investor and the Trader. We do not vet, endorse, or background-check any Trader or Investor.
5.5 Release of Liability
You hereby release the Interface Provider from any liability regarding losses incurred from funding other users or receiving funding from other users, including losses caused by Trader negligence, malicious acts, "rug pulls," or any other actions of other users on the platform.
6User Responsibilities
Traders
- Execute trades responsibly within risk limits
- Maintain wallet security
- Communicate with investors when appropriate
- Close positions before deal deadlines
Investors
- Conduct due diligence on traders
- Understand and accept risks
- Set appropriate risk limits
- Monitor vault performance
7Non-Custodial Nature
Atract does NOT take custody of your funds. All assets remain:
- On the Hyperliquid blockchain
- Under control of your wallet
- Accessible via direct Hyperliquid interface
If Atract becomes unavailable, your funds remain accessible through Hyperliquid directly.
8Fees
The Platform charges minimal fees for services rendered. Hyperliquid network and trading fees also apply. Fee structures may change with notice.
9Disclaimer of Warranties
9.1 "AS IS" Provision
The Interface and all tools are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, the Interface Provider disclaims all warranties, express or implied, regarding the latency, uptime, or error-free operation of the Interface.
9.2 Performance Representations
Any representations regarding performance capabilities are references to the theoretical performance of the underlying Hyperliquid Protocol under optimal network conditions. They do not constitute a service level agreement (SLA) or a guarantee that your specific transactions will be executed with such speed or reliability.
9.3 No Guarantee of Outcomes
Atract does not guarantee:
- Profitability of any trade or strategy
- Accuracy of analytics or performance metrics
- Continuous availability of services
- Security against all threats
- Successful execution of risk controls
9.4 Force Majeure
The Interface Provider shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: acts of God, war, terrorism, civil unrest, blockchain network congestion, smart contract bugs, L1 validator failure, bridge exploits, oracle malfunctions, government action, regulatory changes, or any failure of the Hyperliquid Protocol or Arbitrum network.
10Limitation of Liability
To the maximum extent permitted by law, Atract shall not be liable for:
- Trading losses or missed opportunities
- Service interruptions or failures
- Smart contract bugs or exploits
- Third-party service failures (including Hyperliquid)
- Risk monitoring delays or failures
- Any indirect, incidental, or consequential damages
11Indemnification
You agree to indemnify and hold harmless Atract, its affiliates, and service providers from any claims, damages, or expenses arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any law or regulation
- Any fraud or illegal activity
12Dispute Resolution
Any disputes shall be resolved through binding arbitration. You waive the right to participate in class action lawsuits.
13Modifications
We may modify these Terms at any time. Continued use of the Platform after modifications constitutes acceptance of the updated Terms.
14Termination
We may suspend or terminate your access for:
- Violation of these Terms
- Suspected fraud or illegal activity
- Legal or regulatory requirements
- Any reason at our sole discretion
15Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
